How municipal owners procure work.
State law sets the rules, so they vary. In New York, for example, public work above a stated amount goes to the lowest responsible bidder who furnishes the required security, after advertisement for sealed bids. Bids are publicly opened and read, and at least five days must pass between first publication and the opening.
New York also lets counties, school districts and larger subdivisions keep lists of prequalified bidders for public work, with an appeals process for firms that are denied a place. Bidding is then restricted to firms that qualified before bids were received.
Some owners buy recurring repair and renovation work through job order contracts. Texas law, for example, describes the method as work that recurs while delivery times, type and quantity are indefinite, priced from a unit price book with bidder coefficients. Each state differs, so confirm which statute the owner cites.
