For federal-aid projects, the advertisement and approved plans and specifications must be available to bidders for a minimum period before bids open, and shorter periods need approval. The state must give assurance that all bidders received all issued addenda, and the bidding documents carry required certifications such as a noncollusion provision.
Contractor qualification and prequalification procedures need advance approval, and a contractor cannot be required to hold a license before submitting a bid. Bids are publicly opened and announced, negotiation between opening and award is not permitted, and the state tabulates item details for at least the low three acceptable bids.
State practice varies. Florida's department, for example, publishes each letting's advertisement documents, bid items and addenda online and posts bid tabulations after the letting. Rules on disadvantaged business enterprise participation changed in 2025 and 2026, so confirm the current rule and the owner's instructions.
